Submission Photographs are submitted at client's request, on approval only and must be returned within 15 days except where the library's permission to reproduce has been obtained. In the event of the photographs being reproduced in any way whatsoever including the making of prints, duplicates or art work without reproduction fees being negotiated and agreed to in writing, the fee payable shall be at the sole discretion of the library.
Copyright and Ownership The ownership and copyright of the photographs remains in all cases with the photographer/library. The use to which the client is permitted to put any of the photographs is limited to that described under 'Usage'. The client may not reproduce the photographs in any form whatsoever, nor use them as a reference for any painting, drawing, design or any other art work without the permission of the library. Any reproduction rights granted, as described under 'Usage', may not be sold, transferred or otherwise dealt with.
Handling of Photographs In the event of loss, damage or theft, a minimum fee of R2500 (two thousand, five hundred rand) per original photograph shall be payable by the client to cover the loss of future resale income. The payment of this fee shall not entitle the client to any additional rights in the photographs lost, damaged or stolen. If a photograph is subsequently found, this fee shall be returned, less a holding fee of 10% thereof for each month elapsed after notification of such loss or damage. Any loss, damage or theft should immediately be notified to the library. Duplicate transparencies are subject to the above conditions, but a minimum fee of R300 (three hundred rand) shall apply.
